Introduction and Basis of Agreement
Welcome to Ajmal Fursah Store. This document governs your use of the AjmalFursah.com store and all software applications provided through it, including the "System as You Like" program.
By using the store, or downloading, installing, or running any of our applications, you grant your full legal consent and acceptance of all terms and conditions within this Agreement. These terms are effective immediately upon your use and supersede and replace all previous terms.
Article 1 - Definitions and Product Nature
- The Store: The AjmalFursah.com platform for selling software applications.
- Product/Software: Refers to applications developed and owned by the Store, such as "System as You Like" (referred to hereinafter as the Program).
- Activation/License Key: A digital code purchased once from the Store for perpetual activation of the Program on a single device.
- Product Nature: The Program license is sold as a single, one-time payment and not as an annual subscription.
- Performance and Technology: All applications are programmed in C++/WinRT to ensure maximum performance, small size, and stability.
Article 2 - Eligibility and Lawful Use Conditions
- Eligibility: The Consumer must be an adult (18 years or older) or possess legal authorization from their guardian.
- Compatible Device: The Consumer acknowledges owning a compatible computer that meets the Program's requirements. The Program is not supported for use in Virtual Machine (VM) environments and must be installed on the Host Operating System (Host OS).
- Personal Use: All licenses are intended for personal use only. Resale, redistribution, or unauthorized commercial use is prohibited.
- Prohibition of Tampering: Reverse engineering the Program, attempting to extract the source code, or tampering with the Activation Key or the Program itself is strictly prohibited.
- Suspension and Termination: The Store reserves the right to terminate the validity of the Activation Key or suspend access immediately if the Consumer violates any term of this Agreement.
Article 3 - Activation, Free Trial, and Verification
- Free Trial: The Program offers a full-featured, 30-day free trial starting from the date of the first installation on the Consumer's device, requiring no registration.
- Trial Expiration: After the trial period ends, the Program ceases to function unless a valid Activation Key is purchased.
- License Binding: The Activation Key is for one device only and cannot be transferred. The key is bound to the device's main components (CPU and Motherboard).
- Effect of Component Change: Changing the CPU or Motherboard after activation may result in the key losing its validity and being deactivated, requiring a new license purchase.
- Online Verification: The Program may require a temporary internet connection to verify the validity of the Activation Key or download security updates. No personal data is transmitted during this verification.
Article 4 - Data Privacy, Intellectual Property, and System Safety
- Data Privacy: The Program does not collect any personal data and does not transmit user data outside their device, except for information necessary to bind the Activation Key to the device and verify its validity.
- User Responsibility for Data: The Program may delete temporary files or make system modifications. The responsibility for creating a system restore point or a full backup lies solely with the Consumer. The Developer bears no responsibility for data loss resulting from the absence of a backup.
- Intellectual Property Rights: All intellectual property rights in the software, content, source code, designs, and logos contained in this Store are exclusively owned by Ajmal Fursah or its licensed suppliers and may not be copied, reproduced, modified, or distributed without prior written consent.
- Third-Party Rights: All trademarks and logos related to Microsoft programs and services or any other third party are subject to their terms, and the Program grants no intellectual property rights over them. The Program is not affiliated with or officially endorsed by Microsoft.
Article 5 - Payment, Updates, and Liability Limits
- Electronic Payment: Payment processes are conducted via certified secure payment service providers. The Store does not retain the Consumer's payment card data. Transactions are subject to the service provider's terms.
- Updates and Modifications: The Store reserves the right to modify the programs, pricing, or the terms of this Agreement at any time without prior notice, and continued use of the Program after any modification constitutes implicit acceptance of those changes.
- Limits of Liability: In all cases, the Developer's total liability to the Consumer shall not exceed the value of the license fee paid by the Consumer. The Developer is not responsible for indirect or consequential damages, data loss, or device malfunction.
- Force Majeure: The Store shall not be held liable for any delay or failure to perform obligations resulting from events beyond reasonable control, such as natural disasters, internet outages, or government restrictions.
- Return Policy and Activation Guarantee: Due to the digital nature of the key, the amount cannot be refunded or the license replaced after issuance and delivery, except if the error resulted from the Store. Activation is guaranteed for seven (7) days from the date of purchase.
Article 6 - Governing Law and Jurisdiction
- Governing Law: This Agreement is subject to and shall be construed in accordance with the laws, regulations, and legislation of the Kingdom of Saudi Arabia.
- Jurisdiction: Exclusive jurisdiction for any dispute or claim arising from the use of the Store or this Agreement shall be with the competent courts in the Kingdom of Saudi Arabia.
- Judicial Indemnification: If the Consumer files a lawsuit against the Store and it is rejected or annulled by the competent court, the Consumer is obligated to compensate the Store for all legal fees, attorney costs, and other related expenses incurred by the Store as a result of that lawsuit.
- Official Language: The Arabic language is the recognized language for interpreting the provisions of this Agreement, and in case of conflict with any translation, the Arabic text shall prevail.
